Is Electronic Signing Legally Binding?

Updated

EU Regulations & eIDAS Compliance

Yes. Electronic signatures are fully admissible and legally binding within the European Union.

The legal foundation is governed by the eIDAS Regulation (910/2014/EC), which provides a single, standardized legal framework for electronic identities and trust services across all EU member states.

Key legal protections under eIDAS include:

  • Admissibility in Court: Article 25 of the eIDAS regulation establishes that all electronic signatures and trust services are fully admissible as evidence in legal proceedings.

  • No Discrimination: A signature cannot be denied legal validity or enforcement solely because it exists in an electronic format. Standard e-signatures fully satisfy this legal requirement.

  • Highest Security Tier: Nordic BankID methods are categorized at the highest possible assurance level within the EU framework (Security Level 4).

US Legislation & Cross-Border Signing

For organizations conducting business or signing agreements within the United States, electronic signatures are legally recognized based on four primary requirements:

  1. Intent to Sign: The signing parties must demonstrate a clear intent to sign the document.

  2. Consent to Do Business Electronically: The parties must explicitly agree to conduct their transactions digitally.

  3. Association of Signature with the Record: The signature must be cleanly linked to or logically associated with the specific document being signed.

  4. Record Retention: The finalized document must be stored securely and remain accessible for future reference.

Verified fully complies with all four of these US requirements, provided that the signing parties have acknowledged and accepted the use of electronic signing within the platform.

Cross-Border Transactions

For international transactions across borders, Verified utilizes email authentication and touch-to-sign options. This method safely binds the signer's name, email address, transaction date, and electronic tracking audits (such as IP addresses) directly to the document, operating at Security Levels 2–3.

Technical & Browser Requirements

To guarantee that your signing processes execute securely and without technical interruptions, please ensure your system complies with the following guidelines:

  • Internet Explorer is Not Supported: Internet Explorer does not support the modern web technologies required by BankID and Verified. For security reasons, using an outdated browser for financial and legal services is strongly discouraged.

  • Recommended Browsers: If you have administrative permissions on your device (PC/Mac), you should switch to a modern, supported browser such as Google Chrome.

  • System Maintenance: Ensure that your web browser and your email client are regularly updated to their latest versions. We also recommend clearing your browser's history and cache periodically to ensure optimal performance.
