The parties are not liable for damage / consequential damages caused by obstacles beyond the control of the parties. This only applies when the parties could not reasonably be expected to have considered the obstacle(s) or was able to avoid overcoming the consequences.
Due to the damage caused by a third party to which the party has committed, the party is exempt from liability if the third party would also be exempt based on the rules set out in the first section above. The same applies if the damage is caused by a supplier the party has used.
